On February 8, 2024, Partner David Rutherford obtained summary judgment dismissing federal Section 1983 and Rehabilitation Act claims asserted against a school in Manhattan providing services to students with speech and language disabilities. The plaintiff alleged that her daughter was bullied by other students in the classroom and that when she reported the bullying, the school failed to take action to stop the bullying and then retaliated by kicking her out of the school. The claims were originally dismissed in February of 2023, but the plaintiff was given leave to replead. Even after doing so, the Court deemed the claims insufficient as a matter of law.
