On January 6, 2023, Partner David Rutherford and New York Associate Carolyn Sartori obtained summary judgment in favor of the Port Authority of New York and New Jersey in a premises liability action pending in Queens Supreme Court. The plaintiff fell in a parking lot in front of the American Airlines Hangar at JFK Airport. Unable to sue his employer, the airline, the plaintiff instead brought suit against the operator of the airport, the Port Authority. The Court held that the Port Authority was an out-of-possession landlord and owed no duty to the plaintiff.
