On September 26, 2025, Partner David Rutherford and New York Associate Alexis Yribarren successfully secured a dismissal of an international air carrier in the U.S. District Court for the Southern District of New York on the basis that the Montreal Convention was the plaintiff’s exclusive remedy for an international flight and preempted the plaintiff’s assorted state law tort, contract, and discrimination allegations. As a consequence, the Convention’s two-year statute of limitations, rather than New York’s three-year statute of limitations, applied and the plaintiff’s claims were time-barred.
