Partners Carrie L. Christie and Courtney M. Norton obtained an affirmance from the Georgia Court of Appeals in Summer 2021 of a grant of summary judgment on behalf of McDonald’s. Plaintiff claimed crosswalk stripes were unreasonably slippery and created a hazard that Mcdonald’s knew or should have known existed. The Rutherford & Christie defense team argued that Plaintiff had successfully traversed the area 50-100 times before the incident, and because there had been no other falls on the crosswalk paint, Defendant did not have superior knowledge.
