EXCLUSION OF VOCATIONAL REHABILITATION EXPERT WITNESS

On March 5, 2026, Atlanta Partners Carrie Christie and Courtney Norton and Atlanta Associate Kerry Pointer prevailed on a motion to exclude an expert vocational rehabilitation witness in the United States District Court for the Eastern District of Pennsylvania. The expert opined that the plaintiff, an Uber and Lyft driver, sustained $26,008 in past earnings and would incur $581,597 in future lost earning capacity as the result of a motor vehicle accident. The court excluded the expert’s opinions in toto, finding that he exercised an unreliable methodology in reaching them and that his opinions did not “fit” the facts of the case. The court agreed with Carrie Christie and her defense team that the expert’s opinions were predicated upon the unsupported notion that the plaintiff would be permanently restricted to part-time work for the rest of his working life, and that he used no particular methodology in disregarding the plaintiff’s actual past earnings data and relying instead upon general Bureau of Labor statistics for a commercial driver.
