On December 3, 2025, the U.S. District Court for the Southern District of New York granted a motion for judgment on the pleadings filed by Partner David Rutherford and New York Associate Alexis Yribarren, resulting in the dismissal of the complaint with prejudice. The litigation involved complex claims ranging from breach of contract to alleged violations of the Violence Against Women Act (VAWA) and the Fair Housing Act. The court held that there was a lack of any private right of action under the cited federal statutes and demonstrated a total absence of the consideration necessary to form an enforceable contract. By securing a dismissal at the Rule 12(c) stage, we avoided protracted discovery and the costs associated with same.
