On February 6, 2025, Partner David Rutherford and New York Associate Bobby Rung obtained a dismissal of an action wherein the plaintiff alleged that her cat, Misia, approximately fifteen years old at the time of the alleged incident, was murdered when she was euthanized at an Animal Medical Center.  The case garnered a great deal of attention in the press when it was filed and alleging Veterinarian Malpractice, Breach of Fiduciary Duty, Fraud, Unlawful Deceptive Acts (General Business Law Section 349 and 350), Breach of Contract, Breach of Bailment for Hire, Hospital/Corporate Liability, Lack of Informed Consent, Right of Sepulcher, Intentional Infliction of Emotional Distress, and Negligent Infliction of Emotional Distress. Our motion to dismiss on the pleadings was granted.
