On August 6, 2025, Partner David Rutherford and New York Associate Cassidy Brillhart obtained a decision from New York Appellate Division, Second Department, reversing the lower court’s decision denying summary judgment as to the negligence cause of action asserted against an upstate rehabilitation facility that services people struggling with behavioral health and/or substance abuse issues. The plaintiff alleged that the facility was negligent in hiring, training, and supervising security staff after a guard broke up an altercation in which the plaintiff was involved.
