On May 13, 2025, Partner David Rutherford obtained a dismissal in favor of a summer camp operator Inc. in a sexual abuse action brought pursuant to the Child Victims Act. The plaintiff alleged that he was sexually abused as a child by multiple perpetrators when he attended camp in 1967 and 1968. The plaintiff alleged causes of action for negligence and successor liability in opposition to the defendants’ Motion for Summary Judgment and Motion to Dismiss. Upon denial of the camp’s summary judgment motion, the firm took an immediate appeal and the Appellate Division, First Department, reversed and dismissed the case against our client, the camp operator, in its entirety.
