On June 13, 2016 Partner David Rutherford and New York Associate Lauren Bryant obtained a defense verdict after a week long trial in federal court in White Plains, New York. The plaintiff, a nine year old boy, alleged that he had been sexually abused on repeated occasions at a daycare center. Plaintiff’s counsel requested $10 million from the jury for the daycare center’s alleged negligence in the hiring and supervision of an assistant teacher, along with an alleged breach of assumed duty. The negligent hiring and supervision claims were dismissed during the trial and the issue of breach of an assumed duty went to the jury, which returned its verdict in favor of the daycare center, which was the sole defendant in the case.
