On December 5, 2017 Partner David Rutherford obtained a defense verdict after a six day jury trial in federal court in Brooklyn. The plaintiff, a crew chief for an aircraft services company at JFK Airport, alleged she had suffered a permanently debilitating back injury when the door to a Boeing 767 aircraft, weighing several hundred pounds, malfunctioned and fell on her. Prior to trial, a defense motion to exclude the plaintiff’s liability expert under Daubert was granted. The case went to the jury on both negligence and res ipsa loquitor grounds but, in the end, the jury rendered a verdict for our client, the airline.
